1. Who we are and what this policy covers
Fluxality ("we," "us," or "our") provides AI consulting, implementation, and training services. This Privacy Policy applies to fluxality.com and communications you have directly with Fluxality about our services.
If we process information on behalf of a business client as part of a project, the applicable service agreement and the client’s instructions govern that processing. This policy does not replace those agreements or the privacy policies of websites operated by other organizations.
For questions about this policy or a privacy request, email support@fluxality.com or call (855) 560-6700.
2. Information we collect
Information you provide. When you send an inquiry, we collect the details you submit, such as your name, email address, company name, area of interest, and description of your project. We also receive the content of correspondence you send us. Please do not include passwords, payment card details, or sensitive client information in a general inquiry.
Messaging information. If you separately opt in to text messages, we may collect your mobile number, the scope and record of your consent, message content, delivery information, and opt-out requests. A website inquiry does not, by itself, enroll you in text messaging.
Technical information. Our website and hosting providers may process IP addresses, browser and device information, requested pages, timestamps, and error or security events when you access the site. This information supports site delivery, troubleshooting, and protection against abuse.
3. How we use information
We use information for the following purposes:
- Responding to questions and discussing prospective projects.
- Arranging consultations and managing ongoing client communications.
- Providing services under an agreed scope of work.
- Sending the text messages you have separately agreed to receive and honoring messaging preferences.
- Operating the website, diagnosing problems, and preventing spam, misuse, or unauthorized access.
- Maintaining appropriate business records and meeting applicable legal obligations.
We do not treat acceptance of this policy, use of our website, or a general request for information as consent to receive automated promotional text messages.
4. Service providers and other disclosures
We use providers that support website hosting, content storage, business email, form delivery, security, and communications. They may process information as needed to perform those services for us. Our website uses Cloudflare infrastructure; website inquiries are delivered through our form service to our Microsoft 365 business mailbox. Text message delivery may use Twilio and participating telecommunications carriers.
We may disclose information when required by law or a valid legal process, or when reasonably necessary to investigate abuse, protect rights and safety, or resolve a dispute. Information may also be handled in connection with a business reorganization or transfer, subject to applicable law and the commitments in this policy.
The mobile information and consent restrictions in the next section apply to our SMS program and are not overridden by the general descriptions of sharing above.
5. Mobile information and SMS privacy
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. We do not sell or rent mobile numbers, text messaging opt-in data, or consent records. Text messaging originator opt-in data and consent are not shared with third parties for their own use.
Providers that deliver or support our messaging program may process mobile numbers and related records on our behalf solely to operate that program. This does not permit them to use your mobile information for their own advertising or marketing.
The Fluxality SMS Updates program covers inquiry follow-ups, appointment coordination and reminders, and client or service updates within the scope of your opt-in. Message frequency varies with your requests, appointments, and service activity. Message and data rates may apply.
Reply STOP to a Fluxality text to unsubscribe. You may receive a final confirmation of your opt-out. Reply HELP for assistance, or contact support@fluxality.com or (855) 560-6700. We may retain the limited records needed to honor your opt-out and document consent history.
See our Terms & Conditions for the messaging program terms. Consent to text messages is optional and is not a condition of purchasing services.
6. Cookies and third-party resources
The site and its infrastructure may use cookies or similar mechanisms for essential functions such as security and authenticated administration. You can manage cookies through your browser settings; blocking them may affect functions that depend on them.
The site loads fonts from Google Fonts. When your browser requests those resources, Google receives the technical information necessary to serve them, such as your IP address and browser request details. Third-party sites you choose to visit through links have their own privacy practices.
7. Retention and security
We retain information for as long as reasonably needed for the purposes described in this policy, including responding to inquiries, providing services, maintaining records, honoring opt-outs, and meeting legal obligations. Retention depends on the nature of the information and our relationship with you.
We use access restrictions and technical measures intended to protect information. No website, communications channel, or storage system can be guaranteed completely secure. Our service providers may process information in the United States or other countries where they operate.
8. Your choices and requests
You can ask us to correct contact details, stop optional communications, or consider a request to access or delete information we hold about you. Depending on where you live and the law that applies, you may have additional rights concerning your personal information. We may need to verify your identity and retain information where an applicable exception or obligation requires it.
Send privacy requests to support@fluxality.com. Do not send identification documents unless we explain why a limited verification step is needed. To stop SMS messages, reply STOP to the sending number. Opting out of texts does not prevent you from contacting us by email or phone.
9. Children’s information
Our website and services are intended for business audiences and are not directed to children under 13. We do not knowingly collect personal information from children under 13. Contact us if you believe a child has provided information so we can review and address it.
10. Policy updates and contact
We may update this policy as our services or practices change. The effective date above identifies the latest version. Where required, we will provide additional notice of material changes. A policy update does not itself expand the text messaging consent you previously gave.
